In response to the novel coronavirus (COVID-19) public health emergency, the United States Department of Agriculture (USDA) has granted a nationwide waiver of food service management company (FSMC) contracts duration requirement. This waiver applies to School Food Authorities (SFAs) who administer the National School Lunch Program (NSLP)/School Breakfast Program (SBP)/Summer Food Service Program (SFSP) and SFSP sponsors.
This waiver permits SFAs and SFSP sponsors to negotiate a one-year FSMC contract extension that would not otherwise be eligible for extension through SY 2020-20201 or June 30, 2021. SFAs and SFSP sponsors may use emergency noncompetitive procurement methods to negotiate the one-year FSMC extension or a new contract for SY 2020-2021/SFSP 2020. Please note that contracts resulting from noncompetitive proposals may not exercise renewal options.
All SFAs and SFSP sponsors that contract with a FSMC must complete this form by June 19, 2020 to notify SED on how they will proceed in the 2020-2021 school year and/or the 2020 SFSP, and if the contract duration waiver will be used.
Once agreed upon by both parties, new FSMC contracts and contract extensions must be submitted to the Child Nutrition Office. SFAs must submit a copy of the contract/extension to firstname.lastname@example.org and nonprofit organizations and government entity SFSP sponsors must submit a copy of the contract/extension to email@example.com.
