Waiver Request Notification

The New York State Education Department (NYSED) is requesting to waive requirements for determining eligibility for free and reduced price meals and free milk in schools under regulations at 7 CFR sections 245.6(c)(1) and 245.6(c)(2). This waiver allows school food authorities implementing standard counting and claiming methods in their federal school meals programs to use 2023-2024 school year student eligibility determinations for the first 60 operating days of the 2024-2025 school year. This waiver would allow school food authorities using standard counting and claiming methods in their federal school meals programs to apply student eligibility determinations from the 2023-2024 school year for the first 60 operating days of the 2024-2025 school year. The waiver is necessary to prevent any interruption in free meal benefits for eligible students while the state direct certification matching system undergoes unanticipated maintenance.

To file a program discrimination complaint, a Complainant should complete a Form AD-3027, USDA Program Discrimination Complaint Form which can be obtained online at: https://www.usda.gov/sites/default/files/documents/ad-3027.pdf, from any USDA office, by calling (866) 632-9992, or by writing a letter addressed to USDA. The letter must contain the complainant’s name, address, telephone number, and a written description of the alleged discriminatory action in sufficient detail to inform the Assistant Secretary for Civil Rights (ASCR) about the nature and date of an alleged civil rights violation. The completed AD-3027 form or letter must be submitted to USDA by:
