NY State’s Ban on Foam Containers Used for Prepared Food and Beverages
Effective January 1, 2022, no covered food service provider or store is allowed to sell, offer for sale, or distribute disposable food service containers that contain expanded polystyrene foam in New York State.  This includes elementary and secondary schools, colleges, and universities.

Any facility, regardless of its income, operated by a not-for-profit corporation or by a federal, state, or local government agency that provides food and meals to food insecure individuals at no or nominal charge, may request a 12-month financial hardship waiver.

Guidance documents are available to assist with switching to alternative containers and packaging.  Descriptions, uses, and performance of each material are listed in DEC's Reference Guide for Alternatives to Single-use Expanded Polystyrene Foam.  Educational materials including a fact sheet, tip card, graphics and social media toolkit are available.

The new state ban does not cover NYC as NYC implements its own foam ban.

To file a program discrimination complaint, complete the USDA Program Discrimination Complaint Form, AD-3027, found online at How to File a Program Discrimination Complaint and at any USDA office or write a letter addressed to USDA and provide in the letter all of the information requested in the form.
