Summer Food Service Program Waivers Rescinded

USDA’s Food and Nutrition Service (FNS) recently released SFSP 01-2019. This memo rescinds six waivers previously granted to the Summer Food Service Program in response to a recent audit conducted by the Office of Inspector General (OIG). These flexibilities will no longer be available to Summer Food Service Program Sponsors:

  3. SP 06-2014, SFSP 06-2014, CACFP 03-2014, Available Flexibilities for CACFP At-risk Sponsors and Centers Transitioning to Summer Food Service Program (SFSP), November 12, 2013
  4. SP 10-2017, SFSP 06-2017, Meal Service Requirements in the Summer Meal Programs, with Questions and Answers - Revised, December 5, 2016
  5. SP 10-2017, SFSP 06-2017, Meal Service Requirements in the Summer Meal Programs, with Questions and Answers - Revised, December 5, 2016
  6. Summer Food Service Program (SFSP) Waiver for Closed Enrolled Sites, November 17, 2002

In summary, the rescinded flexibilities will no longer allow Sponsors to:

  • • Waive site visits during the first week of program operation
  • • Utilize Offer Verses Serve unless they are a School Food Authority (SFA)
  • • Qualify closed enrolled sites for the summer food program using area eligibility

Additionally, program information may be made available in languages other than English.

To file a program discrimination complaint, complete the USDA Program Discrimination Complaint Form, AD-3027, found online at How to File a Program Discrimination Complaint and at any USDA office or write a letter addressed to USDA and provide in the letter all of the information requested in the form.
