SFSP Waiver Request Approvals

The New York State Education Department (SED) has received approvals for all three waiver requests submitted to the United States Department of Agriculture Food and Nutrition Service for rescinded policy waivers as issued in SFSP 01-2019, Summer Food Service Program Memoranda Rescission, October 11, 2018. The following waiver approvals are for:

Waiver Request 1 – Policy extending Offer versus Serve using the SFSP Meal Pattern for all sponsoring organizations  (statutory and regulatory requirements rescinded in SP 10-2017, SFSP 06-2017.)

Waiver Request 2 – Policy waiving meal time restrictions; specifically, meal service time duration and the minimum amount of time that must elapse between meals (statutory and regulatory requirements rescinded in SP 10-2017, SFSP 06-2017.)

Waiver Request 3 – Policy extending area eligibility to closed enrolled sites (statutory and regulatory requirements rescinded in Summer Food Service Program (SFSP) Waiver for Closed Enrolled Sites.)

The letter must contain the complainant’s name, address, telephone number, and a written description of the alleged discriminatory action in sufficient detail to inform the Assistant Secretary for Civil Rights (ASCR) about the nature and date of an alleged civil rights violation. The completed AD-3027 form or letter must be submitted to USDA by:
